General Terms and Conditions (GTC) of MoreThanPerfume

1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts for the delivery of perfume that a consumer or entrepreneur (hereinafter "Customer") has with MoreThanPerfume (hereinafter "Seller") with regard to the perfumes presented by the Seller in his online shop completes. The inclusion of the customer's own terms and conditions is hereby objected to, unless otherwise agreed.

1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Conclusion of contract

2.1 The product descriptions contained in MoreThanPerfume's online shop do not represent binding offers on the part of the seller, but rather serve to make a binding offer by the customer.

2.2 The customer can submit the offer using the online order form integrated into the online shop. After placing the selected perfumes in the virtual shopping cart and going through the electronic ordering process, the customer submits a legally binding contractual offer with regard to the perfumes contained in the shopping cart by clicking the button that completes the ordering process. The customer can also submit the offer to the seller by email.

2.3 The seller can accept the customer's offer within five days by sending the customer a written order confirmation or an order confirmation in text form (fax or email), whereby the receipt of the order confirmation by the customer is decisive, or by sending the delivers the ordered perfumes to the customer, whereby the receipt of the goods by the customer is decisive, or by asking the customer to pay after placing his order.

If several of the aforementioned alternatives are present, the contract is concluded at the point in time at which one of the aforementioned alternatives occurs first. The period for accepting the offer begins on the day after the customer sends the offer and ends at the end of the fifth day following the sending of the offer. If the seller does not accept the customer's offer within the aforementioned period, this is deemed to be a rejection of the offer with the result that the customer is no longer bound by his declaration of intent.

3. Right of withdrawal

3.1 Consumers generally have a right of withdrawal. Further information on the right of withdrawal can be found in the seller's cancellation policy.

3.2 The right of withdrawal does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address is outside the European Union at the time the contract is concluded.

4. Prices and payment terms

4.1 Unless otherwise stated in the seller's product description, the prices stated are total prices and include statutory sales tax. Any additional delivery and shipping costs that may arise will be stated separately in the respective product description.

4.2 The payment options are communicated to the customer in the MoreThanPerfume online shop.

5. Delivery and shipping

5.1 Perfumes are delivered by shipping to the delivery address specified by the customer, unless otherwise agreed.

5.2 The delivery time is usually 2-3 working days from receipt of payment, unless otherwise agreed.

5.3 If the customer collects the goods themselves, MoreThanPerfume will first inform them by email that the perfumes they have ordered are ready for collection. After receiving this email, the customer can pick up the perfumes in person after consultation with MoreThanPerfume.

6. Retention of title

If MoreThanPerfume makes advance payments, the seller reserves ownership of the delivered goods until the purchase price owed has been paid in full.

7. Liability for defects (warranty)

7.1 If the purchased item is defective, the provisions of statutory liability for defects apply.

7.2 The customer is asked to complain to the deliverer about delivered goods with obvious transport damage and to inform the seller of this. If the customer does not comply with this, this will have no impact on his legal or contractual claims for defects.

8. Applicable law, place of jurisdiction

8.1 The law of the Federal Republic of Austria applies to all legal relationships between the parties, excluding the laws on the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.

8.2 The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the seller is the seller's registered office, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
